Immediately after the Lemon Law was passed, we read the provisions word for word and read between the lines to make sure we know this law by heart including the implementing rules and regulations. The government gave way to the public’s clamor to protect them from unscrupulous car dealers and from vehicles that were presumed to have hidden defects. The Lemon Law is like a remedy.
The Lemon Law could also be used by some not-so-nice people to take advantage of the dealers that’s why we also asked our lawyers to analyze the provisions to make sure nothing skips our every understanding and interpretation of the law. We also have to protect ourselves from misconceptions of clients who might conclude that Lemon Law could cure every car’s sickness.
True enough, some customers who’ve been using their cars for several months and years, would conclude that their vehicle’s problem is still covered under this law.
As a dealer, it is our every wish that every single car that rolls out of our driveway will be appreciated and enjoyed by the new owner for many many years. The last thing that we want is for them to experience stress in owning the car. However, it is beyond our human capacity to guarantee that 100% of the cars we sell will not conk out one way or another. Like people, cars do get sick. They also get into accidents if not handled properly. Unfortunately even with the best drivers and the most defensive and careful drivers also get into accidents for reasons beyond our control and understanding.
For Lemon Law, it is best to know the basic rules so that customers would also be able to understand it and use it for their protection:
1. This only applies to brand-new vehicles bought from the dealer.
2. If the vehicle suffers problems after several months or years, that’s not covered by the Lemon Law. You’ve used it for several months that means the car is working well.
3. Problem must be recurring and could not be fixed by the repair shop. Kung paulit-ulit yung parehong sira, and bago pa ang sasakyan, like days, weeks pa lang at hindi kayang kumpunihin ng dealer. Pero kung yung kotse mo eh ilang beses nadala sa shop for different reasons, at nare-repair naman, hindi yun lemon.
