I am strongly against the Death Penalty

The death penalty for heinous crimes in the Philippines was outlawed by then president Gloria Macapagal-Arroyo. It would soon be reinstated with the directive and signal from Pres. Duterte.

I am strongly against the death penalty most especially now that the present government is blood-thirsty. They are expanding the coverage to include plunder and even bribery.
My God.

1. Treason —– define treason. Does this include top officials of the land cavorting with other countries for something they alone believe but actually this could be detrimental to the interest of the Filipino people? Does this include not imposing our sovereign rights over some contested islands?
2. Qualified piracy —- define and qualify piracy. Intellectual property piracy? Who would be put to firing squad/ The owner of the factory of fake CD’s, the employees, the manager, the buyers, the distributors?
3. Qualified bribery —- Define bribery? Who are you going to put to the gallows? The government official? Customs, Police, BIR, munisipyo, barangay captain, mayor, or yung walang choice kundi kailangan makisama?
4. Parricide—- People who murder their parents or family are either psychotic or high in drugs. Either way, they will not be deterred in committing the crime because they are not afraid of the capital punishment because they simply are not in the right frame of mind.
5. Murder — murder cannot not be solved by committing another murder.
There are miscarriages of the law and mistakes committed by investigators. If there was death penalty during the Webb conviction, eh di patay na lahat yung mga grupo na yon. Tapos binaligtad ng Supreme Court, wala pala silang sala. Eh pano yun kung patay na sila. And there were instances where in some guys just happened to be with the group who committed the crime or they were just in the wrong place. So paano, patayin na lang?
Two good examples:

a) While a security guard was off duty, armed men ransacked the house of his boss and killed the wife in the process. There was another guard on duty who pointed at him when questioned by the police. He only found out what happened two days later when he reported for work. He went to the police station to give his statement and to clear his name. When the policemen saw him, they locked him up. He has no money to put bail and no money to get a lawyer. He’s been in jail for 3 years.
b) He and his friends were temporarily staying with a friend in Taytay Rizal. They had several bottles of beer then by 12 midnight, they dispersed and went to their rooms. They head a commotion at 4 am and when they went out to check, they saw one of their friends bleeding. They hailed a tricycle and brought him to the hospital. He died after a few hours. The police did not thoroughly checked the crime scene. They just concluded, oh, kayo ang mga kasama nya sa bahay at bag-inuman kayo. Siguro kayo ang sumaksak sa biktima. Good samaritans contributed money to defend and prove that those three were innocent of the murder charges. After three years pa sila nakalabas. O e pano kung binitay na agad sila, wala naman silang kasalanan.

6. Infanticide — Killing the parent because he/she killed their baby. Now, there are two people that had been killed. Who do we kill for killing the parent?
7. Rape — Rape with murder, I say yes. However, pls see #5. There are miscarriages of justice, Nakakatakot kung mali ang napagbintangan o yung iba ay nadawit lang.
Scenario: Your girlfriend lives alone in a condo (uso na ngayon yan). You went to visit her kasi nag-away kayo the night before. makipag-areglo ka. When you arrived, the door was ajar, you pushed it and walked inside, hello, anybody home? You went inside her bedroom and found her naked, bloodied and no pulse. You panicked and touched her hands, checked her pulse, and hugged her (ala teleserye), the guards came and saw you at the scene of the crime, with blood on your t-shirt, arms and hands.
You killed her. Motive, nag-away kayo the night before. Case closed. Bitay ka.

8. Kidnapping and serious illegal detention — There have been instances wherein the person didn’t know what his companions were planning. Inaya lang sya —“Bro sama ka sa amin, me lakad tayo”. Tapos nangkidnap pala.

9. Robbery with violence against or intimidation of persons —- they should be put in jail for a long time, but not to be killed.

10. Destructive arson — Kung wala namang namatay, ikulong na lang ng mahabang panahon.
11. Plunder — Ikulong na lang din kung wala naman silang pinatay na tao. AT ipasoli yung mga pera na kinuha nila sa gobyerno.

12. Importation of dangerous drugs and/or controlled precursors and essential chemicals — Why don’t you talk to China, they are the alleged supplier.

Para matakot? Deterrent? Maybe, but I am afraid that innocent people could be wrongly accused. Pwedeng maraming madamay. Inutusan lang, inaya lang, bumibisita lang sa lugar, napagkamalan lang, nakisakay lang sa sasakyan eh puno pala ng drugs yung likod, nadamay lang.

I suggest jail terms for all of the following:

Sale, trading, administration, dispensation, delivery, distribution, and transportation of dangerous drugs and/or controlled precursors and essential chemicals
Maintenance of a drug den, dive, or resort
Manufacture of dangerous drugs and/or controlled precursors and essential chemicals
Possession of dangerous drugs
Cultivation or culture of plants classified as dangerous drugs or are sources thereof
Unlawful prescription of dangerous drugs
Criminal liability of a public officer or employee for misappropriation, misapplication, or failure to account for the confiscated, seized and/or surrendered dangerous drugs, plant sources of dangerous drugs, controlled precursors and essential chemicals, instruments/paraphernalia and/or laboratory equipment including the proceeds or properties obtained from the unlawful act committed
Criminal liability for planting evidence concerning illegal drugs.
Carnapping

I believe that the best deterrent to a crime is the certainty that the criminal would be caught.
